Legislative Decree no. 46 of 24 February 1997, article 21
It is prohibited to advertise to the general public devices which, in accordance with the provisions of a decree issued by the Minister of Health, may only be sold on prescription or used with the assistance of a doctor or other health professional. Public advertising of devices other than those referred to in paragraph 1 shall be subject to authorisation by the Ministry of Health. The expert committee referred to in Article 6, paragraph 3, of Legislative Decree no. 30 December 1992, shall give its opinion on applications for authorisation. 541, which for this purpose is composed of a representative of the Medical Devices Department of the Ministry of Health and a representative of the Ministry of Industry, Trade and Craft.
